BACKGROUND
In late 2004, NAMMU provided all members a copy of the announcement with the ruling made in favor of Canada Post Corporation, asserting the Corporation’s Exclusive Privilege extends to all Canadian originating letters weighing up to 500g, whether destined for delivery in Canada or outside of Canada. NAMMU took two initiatives:

The first to petition the Minister Responsible for Canada Post to re-open the gazetting appeal period (the announcement of the ruling was made the day after the 60 day period closed). This would permit mailers time to consider the proposed rates, and provide feedback, since it was highly unlikely any would have bothered scrutinizing the rates if they currently did not use Canada Post. This petition was denied by the Minister and Canada Post Corporation, stating the ruling was merely a reinforcement of the scope of the Exclusive Privilege.

In parallel, NAMMU asked members to provide comments/issues/concerns to assist the preparation of an impact assessment for the mailing industry.

Current impact assessment: Confusion is still very apparent in the mailing industry over this ruling. The mail forwarding party(ies) to whom the ruling would apply, are in the legal process of appeal. Many mailers are not clear to what this Exclusive Privilege applies, have not necessarily changed the status quo. Some Value Add Mailers (VAM) are hesitant about providing intermediate service for their clients and are sending them directly to the mail forwarders or Canada Post; and in fact, find the ruling inhibits their ability to compete for global work where the foreign client wants the destination country’s postal indicia to appear. There is unanimous condemnation of A-B-A Remail: letters originating in Canada that (re)enter Canada with foreign postage, destined for a Canadian recipient.


NEXT
Given the current state of confusion in the mailing industry, Canada Post has accepted the NAMMU invitation to participate in a National Information Forum, June 14, in Toronto.

Agenda items include a status report on current legal proceedings, clarification of the ruling and to what it applies, consideration of any legitimate competitive concerns tabled, next steps.
